Our planning team were asked to review a farm which had a number of agricultural building including an AOC property. There was a section 52 agreement stating that none of the land or farm buildings could be leased, gifted or sold separately from the farm. A number of the buildings had been used over the years for non-agricultural uses including a retail unit and storage warehouse. We applied for a certificate of lawfulness to establish the lawful use of various buildings and an outside sales area, allowing the applicants to continue running the various businesses lawfully. We then varied the S52 legal agreement to allow the buildings and outdoor sales area to be leased separately, meaning the applications could prepare for retirement whilst still have an income stream from tenant businesses.
